Terms of Service

1. Acceptance of Terms
By accessing or using the Dropwave platform ("Service"), operated by Jolly JIG, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Dropwave is a podcast hosting platform that provides audio storage, RSS feed generation, analytics, episode management, and related services for podcast creators. The Service includes web-based tools for uploading, managing, and distributing podcast content.
3. Account Registration
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscription Plans & Billing
Dropwave offers free and paid subscription plans. Paid plans are billed monthly via Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may upgrade, downgrade, or cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing cycle.
Excess bandwidth beyond your plan's allocation is charged at $5 per additional 500 GB. We will notify you before applying overage charges when possible.
5. Fair Use Policy
Paid plans include unlimited audio storage under a fair-use policy. "Fair use" means storage used for legitimate podcast hosting purposes. We reserve the right to limit storage for accounts that abuse this policy, such as using Dropwave as a general-purpose file storage service. We will contact you before taking any action.
6. Content Ownership & Responsibility
You retain full ownership of all content you upload to Dropwave. By uploading content, you grant us a limited, non-exclusive license to host, serve, and distribute your content as necessary to operate the Service (e.g., generating RSS feeds, serving audio files to listeners).
You are solely responsible for the content you publish. You represent and warrant that you have all necessary rights to the content you upload and that your content does not violate any applicable law.
7. Prohibited Content
While we believe in content freedom and do not moderate opinions or viewpoints, you may not use the Service to host content that:
- Constitutes or promotes illegal activity
- Infringes on the intellectual property rights of others
- Contains malware, viruses, or other harmful code
- Is used to harass, threaten, or incite violence against specific individuals
- Contains child sexual abuse material (CSAM)
We reserve the right to remove content or terminate accounts that violate these prohibitions.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.
9. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and process data as described therein.
10. Termination
You may close your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your content will be retained for 30 days to allow you to export your data, after which it may be permanently deleted.
11. Limitation of Liability
To the maximum extent permitted by law, Jolly JIG, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Jolly JIG, LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
13. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Knox County, Tennessee.
